Humanitarian and Compassionate Program

Most applicants who apply under this steam do not meet the requirements for family reunification, economic or refugee programs. They do not qualify because they maybe inadmissible or ineligible. However, they may still present compelling cases to be considered for permanent residence.

According to the Immigration and Refugee Protection Act (IRPA), there should be some relief for exceptional cases “if it is justified by humanitarian and compassionate considerations relating to the foreign national, taking into account the best interests of a child directly affected.”

What then are the common categories that fall into H&C program?

According to the Canadian Council of Refugees, H&C applications for permanent residence usually fall into the following categories, but not limited to:

  1. Refugees who were refused status because of flaws in the determination system
  2. Human trafficking survivors
  3. Family members of refugees or permanent residents
  4. Stateless persons
  5. Victims of family violence who left a family sponsorship because of the violence
  6. Persons whose removal from Canada would involve a serious rights violation, such as lack of treatment for a serious medical condition
  7. Persons from countries to which Canada does not usually deport because of a situation of generalized risk
  8. Persons who have been in Canada for continuously several years
  9. Persons who have integrated in Canada, socially, culturally and with family
  10. Persons who have worked for some time as part of temporary worker programs, such as seasonal agricultural workers.
